Important: These Terms include an arbitration provision. This means that if you have a dispute with us, you may have to resolve it through arbitration rather than in court. Please read the Dispute Resolution section carefully.

We may terminate your access to the Site at any time, for any reason, with or without notice. If you violate these Terms or engage in conduct that is harmful to others, we may immediately terminate your access.

BY AGREEING TO THESE TERMS, YOU AND HOFUND INC ARE VOLUNTARILY WAIVING ANY RIGHT TO A JURY TRIAL FOR ALL DISPUTES COVERED BY THIS AGREEMENT TO ARBITRATE.

Waiver of Class Action

YOU AND HOFUND INC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Arbitration Rules

Any arbitration will be governed by the Consumer Dispute Resolution Procedures of the American Arbitration Association (AAA). The AAA Rules are available at www.adr.org.

Exceptions

Either party may bring claims in small claims court if eligible. Either party may seek injunctive relief in court for violations of intellectual property rights.

Except for the arbitration provision above, these Terms and your use of the Site will be governed by the laws of the State of California, without regard to conflict of law principles.
